The recessed meeting was called to order at 6:10 p.m. with all Members being present, with the exception of Supervisor Alexander, Supervisor Berger, Supervisor Hyland, and Supervisor McConnell, and with Chairman Davis presiding.

Supervisor Alexander was absent from the entire meeting.

Supervisor McConnell arrived at 6:20 p.m.

Supervisor Hyland arrived at 6:30 p.m.

Supervisor Berger arrived at 7:20 p.m.

3.MOMENT OF SILENT MEDITATION (Tape 2)

Supervisor Hyland asked unanimous consent that everyone present in the Board Room observe a moment of silent meditation in memory of Mrs. Ruth Freaney, a dedicated resident of the Mount Vernon District, who passed away last evening. Without objection, it was so ordered.

4.BOARD RECESS (Tape 2)

At 7:35 p.m., following the testimony of Ed Brazill (Speaker Two) Chairman of the Coalition of Mentally Disabled Citizens of Northern Virginia, Chairman Davis announced that the Board would recess briefly in order to confer with a group of concerned citizens in the lobby.

At 7:45 p.m., the Board reconvened in the Board Room with all Members being present with the exception of Supervisor Alexander, Supervisor Dix, and Supervisor McConnell, and with Chairman Davis presiding.

Information Requested Regarding County

Staffing Levels of 1987

Following the testimony of Nancy Beyer (Speaker Number 24) representing the Association for Retarded Citizens of Northern Virginia, Chairman Davis relinquished the Chair to Acting-Chairman Hyland and asked unanimous consent that the Board direct staff to provide information at the next Budget Subcommittee Meeting scheduled on Tuesday, April 14, 1992, regarding the County staffing levels which were in existence for the year 1987. Without objection, it was so ordered.

Acting-Chairman Hyland returned the gavel to Chairman Davis.

Legislative Update on Proposed Cigarette

Tax Increase

Following the testimony of Gail Schwarz (Speaker 61) Vice-President, Robinson Secondary School Parents and Teachers Association (PTA), Supervisor Hanley briefed Board Members on the latest legislative action with regard to the proposed increase in the cigarette tax for Fairfax County.

Following discussion, Supervisor Hanley moved that the Board ask the Northern Virginia Delegation to the General Assembly to not allow anything to survive the General Assembly which would, in fact, cause Fairfax County to lose the authority which it now has to levy an increase in the cigarette tax for this fiscal year. This motion was seconded by Supervisor Trapnell.

As a point of clarification, Chairman Davis stated that the legislation as passed by the General Assembly would have allowed Fairfax County to address an increase in the cigarette tax in this fiscal year. However, Governor L. Douglas Wilder has decided that the County will have to put the tax increase to referendum in November, which precludes having any of the monies to use during the current fiscal year. He added that, in essence, the Board of Supervisors is asking the Delegation in Richmond to reject the Governor's amendments. Chairman Davis noted that Fairfax County would rather go back to where things stood a year ago, and revisit this item next year, rather than accept Governor Wilder's amendment.

Chairman Davis relinquished the Chair to Acting-Chairman Hyland and asked that the motion be amended to include a request that the Northern Virginia Delegation obtain a letter of clarification from the State Attorney General addressing the retroactive payment of the $2.2 million presently due Fairfax County (which would be wiped out by the Governor's signature), and this was accepted.

The question was then called on the motion, as amended, which carried by a vote of eight, Supervisor McConnell being out of the room, Supervisor Alexander being absent.

Acting-Chairman Hyland returned the gavel to Chairman Davis.

Volunteer Hour Contributions to the Offender

Aid and Restoration (OAR) Program

Following the testimony of Janeth Welch (Speaker Number 71), Chairman Davis relinquished the Chair to Vice-Chairman McConnell and asked unanimous consent that the Board direct staff to provide more detailed information regarding the monetary value of the hours of volunteer contributions which are made to the Offender Aid and Restoration (OAR) Program. Without objection, it was so ordered.

Vice-Chairman McConnell returned the gavel to Chairman Davis.

The public hearing was held, with testimony being presented by 85 speakers, and scheduled for continuation on Friday, April 10, 1992 at 9:00 a.m.

6.DISCUSSIONS REGARDING LORTON COMMUTER RAIL

STOP (Tape 7)

Supervisor Hyland asked unanimous consent that the Board schedule approximately 10 minutes of time in Executive Session on the morning of April 11, 1992 for discussion of the Lorton Commuter Rail Stop. Without objection, it was so ordered.
