The recessed meeting was called to order at 9:10 a.m. with all Members being present, with the exception of Supervisor Alexander, Supervisor Frey, Supervisor Hanley, and Supervisor McConnell, and with Chairman Davis presiding.

Supervisor Alexander arrived at 9:25 a.m.

Others present were Richard A. King, Acting County Executive; Robert L. Howell, Acting County Attorney; William Howland, Assistant to the County Executive; Patti M. Hicks and Viki L. Lester, Deputy Clerks to the Board of Supervisors, and Clarice Morris, Office of Clerk to the Board of Supervisors.

2.RECESS/EXECUTIVE SESSION (Tape 1)

At 9:10 a.m., Supervisor Dix moved that the Board recess and go into Executive Session for discussion of matters set forth in the Agenda as well as for discussion of actual and probable litigation and other specific legal matters requiring the provision of legal counsel, as well as for discussion of:

·Legal issues and questions regarding the Lorton Commuter Rail Station.

This motion was seconded by Supervisor Bulova and carried by a vote of six, Supervisor Alexander, Supervisor Frey, Supervisor Hanley, and Supervisor McConnell, not yet having arrived.

At 9:25 a.m., the Board reconvened in the Board Room with all Board Members present, and with Chairman Davis presiding.

Supervisor Bulova moved that the Board of Supervisors certify that, to the best of their knowledge, only public business matters lawfully exempted from the open meeting requirements prescribed by the Virginia Freedom of Information Act and only matters identified in the motion to convene Executive Session were heard, discussed or considered by the Board during the Executive Session. This motion was seconded by Supervisor Alexander and carried by unanimous vote.

Certificates of Publication were filed from the Editors of the Washington Post showing that notice of said public hearings on the following had been duly advertised in that Newspaper as described:

At 10:55 a.m., Chairman Davis announced that he and Supervisor Hanley would be leaving momentarily to attend a meeting located at Fairfax City Hall regarding the Oil Tank Farm spill.

The public hearing was held, with testimony being presented by 33 speakers.

Absence of Supervisor McConnell and Chairman Davis

Acting-Chairman Alexander announced that both Supervisor McConnell and Chairman Davis had attended a meeting outside of the Massey Building Complex. He stated that they were returning to the budget hearings and had requested him, in the interim, to convene the hearing.

Northwest Center for Community Mental Health Men's Program

Following the testimony by Susan Milner (Speaker Five), Acting-Chairman Alexander relinquished the Chair to Acting-Chairman Hyland and asked unanimous consent that the Board direct staff to report on whether the Men's Program at the Northwest Center for Community Mental Health is in the first or second round of budget cuts. Without objection, it was so ordered.

Acting-Chairman Hyland returned the gavel to Acting-Chairman Alexander.

Upon his return to the Board Room at 2:25 p.m., Acting-Chairman Alexander returned the gavel to Chairman Davis.

Arrival of Absent Board Members

Supervisor Hanley announced that she had not been present when the meeting convened today because she had attended a meeting regarding the Oil Tank Farm. She stated that she would review the testimony of the speakers she had not heard.

Chairman Davis announced that he had not been present when the hearing convened today because he had also attended the Oil Tank Farm meeting, and afterwards, had to represent the Board at a luncheon. He stated that he had staff members present in the Board Room who would relay to him the testimony he had not heard.

Supervisor McConnell stated that she had also attended the luncheon with Chairman Davis and would review the testimony of the speakers she had not heard.

Following the testimony by Al Hausburg (Speaker 45), Supervisor Alexander asked unanimous consent that the Board direct staff, as speakers present their testimony at these budget hearings, to announce whether the programs they are addressing are in the first or second round of budget cuts. Without objection, it was so ordered.

BOARD MATTERS

9.EXTENSION OF DATE FOR PLANNING COMMISSION'S

RECOMMENDATIONS TO THE BOARD ON PROPOSED

AMENDMENTS TO THE CODE OF THE COUNTY OF FAIRFAX,

CHAPTER 112 (ZONING ORDINANCE) REGARDING

COMMERCIAL AND INDUSTRIAL (C&I) DISTRICTS

Supervisor Dix announced that on Thursday, April 9, 1992, the Planning Commission held its mark-up on the proposed amendments to the Code of the County of Fairfax, Chapter 112 (Zoning Ordinance) regarding the Commercial and Industrial (C&I) Districts. The Commission took action on the proposed amendments for the C-5 through C-8 Districts and Industrial Districts but did not complete its deliberations on the new C-9 District and Grandfather Provisions. He stated that the Commission has requested that the Board authorize an extension of the date established for the Commission to forward its recommendation to the Board. The existing date is April 21, 1992 and an extension is needed until April 24, 1992 to allow additional time for the Commission to complete deliberations.

Supervisor Dix stated that the extension will not necessitate deferral of the Board's public hearing date scheduled for May 4, 1992. Therefore, he moved that the Board authorize extension of the date for receipt of the Commission's recommendation to April 24, 1992. This motion was seconded by Supervisor McConnell and carried by a vote of nine, Supervisor Hyland being out of the room.

10.CONTRACTS OF SALE - ALONZO SCOTT AND MARGARET

FAITH SCOTT PROPERTIES, PROJECT 88A004 - RESTON

SOUTH COMMUTER PARK AND RIDE LOT (CENTREVILLE

DISTRICT) (Tape 10)

Supervisor Dix moved that the Board authorize the Deputy County Executive for Planning and Development to execute three contracts of sale for the following properties:

·Alonzo Scott and Margaret Faith Scott

2601, 2605, and 2609 Fox Mill Road

Tax Map Numbers 026-3-01-0001, 0003, and 0004

Supervisor Dix stated that these properties are required as part of an assemblage of parcels necessary for the Reston South Commuter Park and Ride Lot and is well within the budgeted amount for those pieces of properties. This motion was seconded by Supervisor Frey and carried by a vote of nine, Supervisor Hyland being out of room.
