Obtaining a Continuance in a Criminal Case

  1. Motions for continuance are not placed on the docket. The party requesting the continuance must make arrangements with the Commonwealth Attorney's office to meet in Judge's chambers to see the Calendar Control Judge. Generally, the Calendar Control Judge is available 8:30 a.m. - 9:30 a.m., Monday through Friday.

  2. Prior to seeing the Calendar Control Judge, the moving party must complete the Request for Continuance form, which is available in either Judge's Chambers or in the Commonwealth Attorney's office. The moving party may request that the Commonwealth Attorney endorse the Continuance Form if they are unavailable to meet with the Calendar Control Judge. The moving party can then proceed to Judge's Chambers with the endorsed Continuance Form to meet with the Judge.
