TextBuildable Lot Validation Request
What is a Buildable Lot Validation Request? It's a formal application that can be made to the county that seeks to clarify the status of a particular lot or parcel within the county with regard to the issuance of a building permit for that lot or parcel.
The county's Zoning Ordinance contains specific language that requires a lot to comply with certain geometric standards that are based on the underlying zoning of that lot. It also stipulates that no building permit can be issued for a lot that does not comply with the provisions of either the Zoning or the Subdivision Ordinance. Because of when and how a lot was first created, it may be that the lot does not comply with one or both of these ordinances.
Does this indicate that the lot is buildable? The Zoning and Subdivision Ordinances each provide for some flexibility in this regard based on when and how a lot was first created and if the lot met the geometric standards that were in effect at the time. Where it can be determined that a lot, when created, met the criteria that is outlined in each of two ordinances, then the lot can be considered to be a valid buildable lot, and the lot may be considered to be eligible for the issuance of a building permit.
How can I submit a Buildable Lot Validation Request? To make a Buildable Lot Validation Request to the county, you may submit the request online or complete this form (PDF), print and fax the completed form to 703-324-3921. Please include your email address so that we may contact you with your project number. All Buildable Lot Validation Requests will be assessed a $348 per lot review fee. Processing of the request will not occur until payment has been received through the Plan and Document Control Section. Payments may be made by visiting the Plan and Document Control Section located on the fifth floor of the Herrity Building at 12055 Government Center Parkway or by mailing payment to: Plan and Document Control Section, 12055 Government Center Parkway, Fairfax, VA 22035. Checks should be made payable to Fairfax County and should include your project number (ex. 1234-LV-001-1). Please allow 4-6 weeks for processing of your request.
How can I check on the progress of my request? Using the county's web page, the status of your request can be monitored by linking to the county's Land Development System at Land Development System. From this page, select the option to search by Plan and Waiver Number. By entering the project number of your request, you will be able to view the status of your submission.
