Lot Validation Request

What is a Lot Validation Request? It's a formal application that can be made to the county that seeks to confirm the validity of a particular lot or parcel within the county with respect to whether or not it was legally recorded in conformance with the Subdivision Ordinance in effect at the time of its creation and meets all of the zoning requirements of the Zoning Ordinance in effect at the time of its creation.

The county's Zoning Ordinance contains specific language that requires a lot to comply with specific geometric standards and requirements of the underlying zoning district in which it is located. It also stipulates that a building permit cannot be issued for any lot that does not comply with the provisions of either the Zoning or the Subdivision Ordinance in effect at the time of the lot's creation.

Does this indicate that the lot is buildable? The lot validation will confirm that the lot was legally created and meets the requirements and standards of the Zoning Ordinance.  It is then up to the property owner or developer to evaluate such items as topography, floodplain, Resource Protection Area, soils, access, availability of utilities, etc., to determine whether or not the lot is buildable. If a lot is valid, and a plan can be submitted and approved by the county to confirm that all Public Facilities Manual and county requirements can be met, then that lot is deteremined to be buildable.

How can I submit a Lot Validation Request? A lot validation request is submitted online, or filled out and submitted in person at the Site and Addressing Center located in the Herrity Building at 12055 Government Center Parkway. Lot Validation Request fees are assessed per the Fee Schedule. Processing of the request will not occur until payment has been received through the Site and Addressing Center. Checks should be made payable to Fairfax County and should include your project number (ex. 1234-LV-001-1). Please allow 4-6 weeks for processing of your request.

How can I check on the progress of my request? Using the county's web page, the status of your request can be monitored by linking to the county's Land Development System. From this page, select the option to search by Plan and Waiver Number. By entering the project number of your request, you will be able to view the status of your submission.
