Discrimination in Employment

The Fairfax County Human Rights Ordinance prohibits discrimination in employment. Employers having four or more employees, employment agencies and labor organizations may not discriminate on the basis of race, color, sex, religion, national origin, marital status, age or disability when making employment decisions; and they may not retaliate against anyone who alleges that he or she has been a victim of illegal discrimination. Anyone believing that he or she has been discriminated against in employment should contact the Human Rights Commission. The Commission's staff will also make sure that your complaint is filed with the U. S. Equal Employment Opportunity Commission when appropriate.

You may be the victim of discrimination in employment if:

  • You are a female working in the same position as a male, but are paid a lower salary
  • a company refused to hire you because you use a wheelchair even though you were the most qualified applicant
  • You were denied a promotion because you are age 40 or older
  • You are subjected to harassing comments on the job that are related to your sex, race, religion, color, national origin, marital status, age, or disability
  • You were terminated from your job because of your pregnancy
  • You were terminated from your job because you protested what you believed in good faith to be an act of illegal discrimination

Discrimination in Housing

The Fairfax County Human Rights Ordinance prohibits discrimination in housing. Any person who refuses to sell, lease, or sublease or rent on the basis of race, sex, religion, color, national origin, age, marital status, disability, or familial status may be discriminating. Familial status refers to a family with children under the age of 18. Any person who believes he or she has been the victim of housing discrimination should contact the Human Rights Commission.

You may be the victim of discrimination in housing if:

  • You were denied rental or purchase of housing because of your race, sex, religion, color, national origin, age, marital status, disability or familial status
  • You were denied a mortgage or private mortgage insurance because of your race, sex, religion, national origin, marital status, familial status, or disability
  • Your home owners insurance company charges you higher premiums because of the racial makeup of your neighborhood
  • You were told that an apartment has been rented, yet you continue to see it advertised
  • You have been a victim of a cross-burning, panic selling, racial epithets, or "blockbusting"
  • You were told that no children are allowed
  • The landlord refused to accommodate your disability by allowing you to make the apartment more accessible

Discrimination in Public Accommodations

The Fairfax County Human Rights Ordinance states that no person shall be denied admission to or equal use and enjoyment of a public accommodation because of race, sex, religion, national origin, age, marital status, or disability.

You may be a victim of discrimination if:

  • You were denied access to a restaurant or other place of business because of your race, national origin, religion, color, or disability
  • You were denied access to a taxi cab or restaurant because you needed to be accompanied by an animal to accommodate your disability
  • You were denied a hotel room because of your race, sex, national origin, religion, age, marital status, or disability
  • You were charged a higher rate than others for a service because of your race, sex, religion, national origin, marital status, or disability
  • You were denied membership in a community swimming pool because of your race, national origin, religion, or disability
  • You were denied access to a rental office because of your disability

Discrimination in Credit

The Fairfax County Human Rights Ordinance states that no credit facility may refuse to furnish credit or other credit related services, or terminate credit, or provide unequal credit terms because of one's race, sex, religion, national origin, color, marital status, age, or disability.

You may be a victim of discrimination in credit if:

  • You were denied credit because of your race, sex, national origin, religion, color, marital status, or disability
  • You were charged a higher rate of interest because of your race, sex, religion, national origin, color, marital status, or disability
  • You were provided with different terms and conditions because of your race, sex, religion, national origin, color, marital status, or disability

Discrimination in Education

The Fairfax County Human Rights Ordinance states that it shall be an unlawful act for any educational institution or its agents, employees, or officers on the basis of age, race, religion, sex, national origin, color, marital status, or disability to discriminate against any person with respect to the terms, conditions, accommodations, advantages, facilities, benefits, privileges, or services of that institution.

You may be a victim of discrimination if:

  • You were refused acceptance into a private school because of your race, sex, religion, national origin, color, marital status or disability
  • You were denied any educational opportunity offered by a private school because of your race, sex, religion, national origin, color, marital status, or disability
