Statement From the Fairfax County Electoral Board

“Under Virginia State Law, (VA Code Section 24.2-800), when a race is decided by a margin of not more than one percent of the total vote cast as determined by the State Board or the local electoral board, the defeated candidate may appeal from that determination for a recount of the vote. That petition must be made within 10 days from the day that the local electoral Board or State Board of Election certifies the election. The petition must be made to the Circuit Court of Richmond (for statewide candidates) or the Circuit Court for the jurisdiction in which the challenged candidate resides.

The Fairfax County Electoral Board stands ready to complete our canvass of the returns in the County, the adjudication of provisional ballots and will work to ensure that our canvass of the returns is completed in a timely and accurate fashion. 

Once our returns are certified, we will await the determination of candidates to file petitions for recounts as necessary and will follow Virginia law to comply with those requests.”
