Sets Public Hearing For Stout Property

The Fairfax County Park Authority held a public hearing to receive public comment on the acquisition of property in the Sully District. The property consists of 5.88 acres and is identified on the Fairfax County Real Property Identification Maps as TM 34-2 ((1)) Parcel 12, hereinafter referred to as the "Stout property." The Stout property is located at the end of Barnsfield Road east of Route 28 and northeast of the Sully Historic Site. The acquisition of the Stout property will provide a buffer between the neighboring Dulles Discovery development to the northeast and the Sully Historic Site, giving additional protection to the historical and cultural resources at Sully. Due to its proximity to the Manassas Gap Railroad built in the 1850's, the Stout property is likely to contain artifacts of historic significance.

The Board of Supervisors approved a rezoning for the Dulles Discovery development, RZ 2003-SU-035, in January 2007. One of the proffered conditions for this rezoning required Sully East L.C. ("Sully East") to acquire the Stout property and dedicate it to the Park Authority. The proffer also stated that should Sully East be unsuccessful in acquiring the property, it could request the Park Authority use its power of eminent domain to acquire the Stout property by condemnation. All costs for the acquisition, including that of outside counsel and other legal costs, would be fully paid by Sully East.

Sully East has not been successful in acquiring the property and is now requesting the Park Authority use its power of eminent domain to do so. Pursuant to the proffer, the Park Authority must authorize condemnation of the Stout property within 180 days from the time of the request, or Sully East is no longer obligated to acquire the Stout property. This time period expires on May 20, 2008.
