Authorization of Date Certain
Public Hearing for the
Abandonment of Right of Way on Oakton Road

June 5, 2006

Mr. Chairman

With the approval of the Flint Hill School Special Exception SEA-1999-PR-046 in November 2005, the school was required to abandon unused right of way on Oakton Road. The school has worked with FCDOT staff and has submitted all the required paperwork to proceed with the required street abandonment public hearing process. County FCDOT staff has confirmed that the Flint Hill School now owns all of the fronting parcels and intends to use the land for parking and emergency access. Furthermore, the right-of-way is being abandoned, rather than vacated, because the underlying land is a combination of prescriptive right-of-way for the old roadway and takings by the Commonwealth for the realignment of Oakton Road. The abandonment will have no long-term impact on vehicle circulation and access. Flint Hill School is the only affected property owner. Representatives of the school have asked that the Board help them expedite this process by setting the soonest possible date for the abandonment public hearing.

Motion

To that end, I move that the Board authorize a public hearing to be held on July 10, 2006 to abandon the right of way associated with the approved Flint Hill SEA-1999-PR-046.

This action does not prejudice the consideration of the
pending abandonment process in any way.
