Charitable Organization Registration and Licensure
Title 57, Chapter 5 of the Code of Virginia, requires any organization that solicits donations in Virginia to register with the Virginia Department of Agriculture and Consumer Services (VDACS) unless otherwise excluded or exempted from registration requirements under § 57-48 or § 57-60. Fairfax County Chapter 34 requires charitable and civic organizations that solicit donations in Fairfax County to obtain a license from the Regulation and Licensing Branch prior to soliciting in the county. Chapter 34 exempts organizations that have registered with VDACS from county licensure. Charitable and civic organizations that have registered with VDACS should provide a copy of the letter issued to the organization by VDACS to the Regulation and Licensing Branch. Regulation and Licensing Branch will issue a letter exempting the organization from the county license requirement for one year from the date of issue, or until the organization’s registration with VDACS expires, whichever comes first. All charitable and civic organizations that wish to solicit in Fairfax County must first register with VDACS.
All first-time applicants with Regulation and Licensing Branch are required to submit fingerprints to Fairfax County Police and pay an additional fingerprinting fee of $10. All fingerprints are held on file in the Northern Virginia Regional Information System, the region's fingerprint repository. Applicants are provided with a fingerprint card and instructions by staff after filing a license application. Applicants should not attempt to submit fingerprints prior to filing a license application. This step must be completed after filing an application with the branch.
