Obtaining a Continuance in a Criminal Case


Motions for continuance are not placed on the docket.  The party requesting the continuance must make arrangements with the Commonwealth Attorney’s office to meet in Judges’ Chambers to see the Calendar Control Judge.  Generally, the Calendar Control Judge is available between the hours of 8:30 a.m. - 9:30 a.m., Monday through Friday.  Anyone wishing to appear before the Calendar Control Judge must check-in with the receptionist in Judges’ Chambers by 9:00 a.m.  If you have any questions relating to Calendar Control, contact Judges’ Chambers at 703-246-2221.

Prior to seeing the Calendar Control Judge, the moving party must complete the Calendar Control Order, which is available in Judges’ Chambers, the Commonwealth Attorney’s office and the link below.  If the request for continuance is not opposed by the Commonwealth Attorney, defendant or defense counsel may obtain available dates from the Commonwealth Attorney and ask the Commonwealth Attorney to endorse the Request for Continuance form if he or she is unavailable to meet with the Calendar Control Judge.  The moving party can then proceed to Judges’ Chambers with the endorsed Calendar Control Order to meet with the Judge.
