Fairfax County Receives New MS4 Permit

The Virginia Department of Environmental Quality (DEQ) re-issued Fairfax County's Municipal Separate Storm Sewer System (MS4) permit on April 1, 2015.

The new permit is consistent with those issued to other communities in Virginia and includes several additional requirements or steps that the county must take to protect water quality and prevent pollution from reaching local streams and the Chesapeake Bay.

The previous permit was issued in 2002, before national attention was focused on urban stormwater and prior to the Chesapeake Bay TMDL (Total Maximum Daily Load is the maximum amount of a pollutant that a body of water can receive and still meet water quality standards).

"We are very fortunate to have the Fairfax County Board of Supervisors actively engaged with the permit process through regular updates and discussions with the Board's Environmental Committee," said Randy Bartlett, Deputy Director, Department of Public Works and Environmental Services. "The contents of the new permit are similar to those of permits recently issued to other communities," Bartlett said, "We have programs already in place or in development to ensure compliance."

The five-year funding strategy that was proposed by the County Executive and adopted by the Board of Supervisors places the county in a good position to meet the regulatory mandates of the new MS4 permit. The world of stormwater regulations and the science related to urban stormwater are evolving rapidly.

"We will face some unanticipated challenges but the county is well prepared and positioned to succeed through the policies and programs adopted by the Board of Supervisors," Bartlett said.
