CALL TO ORDER

Commission Chair Gloria Crawford called the Wednesday, July 19, 2017, Commission meeting to order at 7:30 p.m.

Approval of Agenda: It was moved by Commissioner Selim and seconded by Commissioner S. Malik that the June 21, 2017, agenda be approved as presented. The motion passed by unanimous vote.

Approval of Minutes: It was moved by Commissioner S. Malik and seconded by Commissioner Griffin Paul that the June 7, 2017, minutes be approved as amended. The motion passed by majority vote with Commissioners Khairallah and Selim abstaining.

STAFF ISSUES

Mr. Simms updated the Commissioners that the staff met all but one of the Balance Score Card goals for the month.

Commissioners discussed the website. Mr. Michael Simms informed the Commission that the County is transitioning its entire website to a new platform and that the transition is expected to begin later this year. He also emphasized that the new site layout will take care of any previous/concerns that the Commission has raised with the current site.

Mr. Simms also addressed the Commissioners regarding the requirements for the meeting minutes. As discussed during the previous meeting, the minutes will continue to contain the names of the Commissioners who abstain or vote against a motion.

Commissioner Crawford also added that if a Commissioner would like for the meeting minutes to reflect a statement they make they must request for it to be included in the minutes for the record. Commissioner Crawford stated that she will research how meeting minutes are handled by other Commissions and Boards within the county and provide an update at a later meeting.

COMMISSION BUSINESS

HRC #2016101H – FIR. It was moved by Commissioner Khairallah and seconded by Commissioner S. Malik that the complaint in this matter be dismissed due to insufficient evidence that a violation of the Human Rights Ordinance has occurred consistent with the recommendation of OHREP. The motion passed by unanimous vote.

HRC #2016095H – Charge. It was moved by Commissioner S. Malik that the Fairfax County Human Rights Commission Recess and go into closed session for consultation with legal counsel from the Office of the County Attorney (OCA) and briefings by staff members pertaining to possible litigation. This closed session was conducted pursuant to Virginia Code Section 2.2-3711(A) (7), regarding Guerre v. Nichols, HRC #2016095H/HUD# 03-16-4721-8. This motion was seconded by Commissioner Khairallah. The motion passed by unanimous vote.

Following the closed session, Commissioner S. Malik moved that the members of the Fairfax County Human Rights Commission certify that to the best of their knowledge only public business matters lawfully exempted from the open meeting requirements prescribed by the Virginia Freedom of Information Act and only matters identified in the motion to convene the closed session were heard, discussed, or considered by Fairfax County Human Rights Commission during closed session. This motion was seconded by Commissioner Salinas. The motion passed by unanimous vote.

It was moved by Commissioner Griffin Paul and seconded by Commissioner Selim that the Commission issue a charge in the matter of Guerre v. Nichols, HRC #2016095H/HUD# 03-16-4721-8. The motion passed by unanimous vote.

HRC #2017051H- Withdrawal. It was moved by Commissioner Khairallah and seconded by Commissioner S. Malik that the HRC#2017051 be withdrawn for lack of jurisdiction as recommended by OHREP. The motion passed by unanimous vote.

COMMUNITY CONCERNS

The Commission discussed the creation of an Advisory Committee to the Commission for purposes of establishing partnerships and promoting human rights within the community. The Outreach Committee of the Commission will prepare an outline detailing the purpose and function of the proposed Advisory Committee and present it at the next Commission meeting.

PENDING BUSINESS

Awards Committee: Commissioner Crawford gave a quick report. She noted that the Commission may want to partner with fair housing groups or other organizations. Commissioner Crawford also suggested that going forward any proposed awards event be posted/advertised on the main county website.

The Awards Committee will also establish criteria for recognizing retiring and past commissioners and share at the next meeting.
