Transient Occupancy Tax (TOT)
In February 2004,
the Virginia General Assembly adopted a new section to the
Code of Virginia, §58.1-3824. This new section allows
Fairfax County to increase the current rate of Transient Occupancy
Tax (TOT) from 2% to 4%. Following a public hearing on March
29, 2004, the Fairfax County Board of Supervisors amended
the County ordinance to add the additional 2% TOT beginning
July 1, 2004, resulting in a total 4% TOT rate.
Under prior law, the Department of Tax Administration
has never collected a Transient Occupancy Tax (TOT) in towns
located within Fairfax County. Pursuant to §58.1-3824,
also beginning July 1, 2004, Fairfax County will begin collecting
its 2% TOT levied from transient lodging located within town
boundaries.
The revenue derived from these changes will
be used to help promote tourism and fund a non-profit convention
and visitors center in Fairfax County in accordance
with the provisions of the State law.
Questions regarding this change may be sent
to the Personal
Property and Business License Division or by calling 703-222-8234.
