Fire Marshal Permit Requirements


The Fire Marshal administers and issues two types of permits: Construction Permits and Fire Prevention Code Permits (FPCP).

CONSTRUCTION PERMITS

FPD Fire Permit


The Fire Marshal is authorized to act on behalf of the Fairfax County Building Official (DPWES) regarding enforcement of the USBC which includes processing and issuing construction permits (i.e., FPD Permit,  Low-voltage Electrical Permit, Mechanical/Gas Permit) related to fire protection equipment/systems and special locking arrangements.

Once issued, construction permits allow the permit applicant (i.e., licensed contractor) to install or modify systems and equipment for which a permit and/or approval is required under Section 108 of the Uniform Statewide Building Code (USBC), applicable sections of the Fire Prevention Code, and the water and fire regulations section Fairfax County Public Facilities Manual (PFM). FIRE PREVENTION CODE PERMITS (FPCP)

Fire Prevention Code Permit (FPCP)


Sections 107.2 and 108.1.1 of the Fire Prevention Code authorize the Fire Marshal to require operational permits (i.e., Fire Prevention Code Permits) for activities, processes, and occupancies regulated by the Fire Prevention Code.  Once issued, Fire Prevention Code Permits (FPCP) allow the permit applicant to (a) conduct activities involving the handling, storage, or use of substances, materials, or devices regulated by the Fire Prevention Code, (b) conduct processes regulated by the Fire Prevention Code which produce conditions hazardous to life or property, (c) and/or to establish a place of assembly.

Please refer to the following publications and/or links for detailed FPCP requirements and fees, as well as the information about certificates of occupancy (i.e., Non Residential Use Permits, Use Permits, Zoning Inspection Permits, etc.), which are generally required for all commercial occupancies located in Fairfax County and the towns of Clifton, Herndon, and Vienna.  A valid certificate of occupancy is required prior to the issuance of an FPCP.  Questions related to certificates of occupancy should be directed to the appropriate jurisdication listed below.
