                                        Description
                                     
                                        One or both of the parties to a marriage must file an initial complaint with the court requesting a divorce. To obtain a divorce in Virginia either or both parties must be residents of Virginia for at least 6 months prior to filing for divorce. If there are no children from the marriage, there is a 6 month separation reqirement before filing. If there are children, the couple must be separated for 12 months before filing. There are 3 basic steps in filing for divorce: a bill of complaint which specifies the grounds for divorce and opens the case file, submission of a decree of reference, and submission of a decree of divorce which the judge will sign.
