Continuance Requests


CIVIL – Consent by clerk; opposed by motion.

CRIMINAL – Misdemeanors by judge or motion. Felonies by judge with Commonwealth’s Attorney’s agreement.

TRAFFIC – Infractions – 1st by clerk or by automated phone system at (703)-246-3764, 2nd by judge. Misdemeanors by judge or motion

DWI Continuance Policy:

  • All DWI continuance requests filed by defendants or defense counsel must be signed by the prosecutor as either "agreed" or "objected to". If an objection is raised, a brief reason should be noted on the continuance request.
  • All DWI continuance requests must be filed in the Traffic Clerk's Office by 3:00 p.m., at least two business days before the scheduled court date.
  • The Clerk's Office will forward all requests with an objection to Judges' Chambers where they will be reviewed by a judge between 8:15-8:30 a.m. on the following morning.
  • Defense counsel may file a motion if the request is denied.
