Customer shall determine the terms and conditions that end users must comply with. These terms and conditions must, at a minimum (unless otherwise consented to by Tyler in writing) include provisions that are consistent in all material responses with the following provisions:
End User shall not create, upload, or share content that violates third-party copyright, trademark, privacy, data protection, publicity, or other rights or that plagiarizes third party content. Additionally, End User shall not: (a) enter text prompts designed to generate copyrighted, trademarked, or otherwise infringing content; (b) upload or share information or images that includes a third party’s copyrighted content; (c) modify, make derivative works of, disassemble, reverse compile, reverse engineer, or otherwise use any part of the Resident AI Assistant to discover any underlying components of the models, algorithms, and systems, such as exfiltrating the weights of models; (e) access or use the Resident AI Assistant in order to build or support, and/or assist a third party in building or supporting, products or services competitive to Tyler; (f) license, sell, rent, lease, transfer, assign, distribute, display, host, outsource, disclose, permit timesharing or service bureau use, or otherwise commercially exploit or make the Resident AI Assistant available to any third party other than as expressly permitted by these terms and conditions; (g) provide, store, or transmit infringing, unsolicited marketing emails, libelous, or otherwise objectionable, unlawful or tortious material; (h) interfere with or disrupt the integrity or performance of the services (including without limitation, vulnerability scanning, penetration testing or other manual or automated simulations of adversarial actions, without Tyler’s prior written consent); (i) use web scraping, web harvesting, or other data extraction methods to extract data or (j) attempt to gain unauthorized access to the Resident AI Assistant or its related systems or networks.
End User acknowledges and understands that the Resident AI Assistant is not designed to serve as the system of record and shall not be used in a manner where the interruption of the services could cause personal injury (including death) or property damage. The Resident AI Assistant is not designed to process or store data protected under the Family Education Rights and Privacy Act (FERPA), data from Criminal Justice Information Services (CJIS), Health Insurance Portability and Accountability Act (HIPAA) or other personal, sensitive, or protected data. By using the Resident AI Assistant, End User acknowledges and agrees that End User is using the Resident AI Assistant at End User’s own risk is and is solely responsible for use of the Resident AI Assistant in any manner that is contrary to the uses for which the Resident AI Assistant is designed and offered for use in these terms and conditions.
End User acknowledges and understands that Fairfax County is a public body subject to the Virginia Freedom of Information Act (VFOIA). Any Data shared with, generated by, or maintained by the Resident AI Assistant may be subject to disclosure under VFOIA or other applicable law.
End User acknowledges and understands that Resident AI Assistant is not designed or intended for use in locations outside of the United States or by children under the age of 13 years old, and that End User is solely responsible for compliance with any laws applicable to users who choose to access Resident AI Assistant, including from non-US locations.
Though the use of Resident AI Assistant, End Users agree to comply with the following third-party terms and conditions:

End User acknowledges that the Resident AI Assistant may at times limit the services' ability to respond to particular topics, such as probing for personal information or seeking opinions on sensitive topics or current events, even if not prohibited by these terms and conditions.
There is no warranty of the accuracy or reliability of the Resident AI Assistant, and the content generated by the Resident AI Assistant may not always be correct, up-to-date, or applicable to a specific situation, and may be inappropriate or unexpected. Additionally, ALL WARRANTIES AND CONDITIONS, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES, DUTIES, OR CONDITIONS OF MERCHANTABILITY, TITLE OR FITNESS FOR A PARTICULAR PURPOSE ARE HEREBY DISCLAIMED. THERE IS NO WARRANTY TO SECURE THE RESIDENT AI ASSISTANT, AND THERE IS NO GUARANTEE CANNOT BE COMPROMISED. THE RESIDENT AI ASSISTANT IS PROVIDED “AS IS”. END USER UNDERSTANDS THAT THE RESIDENT AI ASSISTANT MAY NOT BE ERROR FREE, AND USE MAY BE INTERRUPTED.
End User may not use the Resident AI Assistant in the following ways:
i. To interact with individuals under the age of consent in any way that could result in exploitation or manipulation or is otherwise prohibited by law or regulation;
ii. To generate or interact with content prohibited in these terms and conditions;
iii. To present content alongside or to monetize content prohibited in these terms and conditions;
iv. To make decisions without appropriate human oversight as part of an application that may have a consequential impact on any individual’s legal position, financial position, life opportunities, employment opportunities, or human rights, or may result in physical or psychological harm to an individual;
v. To deploy subliminal techniques (e.g., visual, auditory, or other signals beyond a normal person’s range of perception) with the intent to deceive or cause harm;
vi. To deceive or intentionally misinform, for false advertising, or to manipulate or distort the behavior of a person in a way that causes harm;
vii. To exploit any of the vulnerabilities of a person (e.g., age, disability, or socio-economic situation);
viii. For social scoring or predictive profiling that would lead to discriminatory, unfair, biased, detrimental, unfavorable, or harmful treatment of certain persons or groups of persons;
ix. To categorize people based on their biometric data or to infer characteristics or affiliations about them such as race, political opinions, trade union membership, religious or philosophical beliefs, or sex life or sexual orientation;
x. To infer people’s sensitive attributes such as gender, race, nationality, religion, or specific age (not including age range, position of mouth (e.g., smile or frown), and hair color);
xi. To attempt to infer people’s emotional states from their physical, physiological, or behavioral characteristics (e.g., facial expressions, facial movements, or speech patterns), including inferring emotions such as anger, disgust, happiness, sadness, surprise, fear, or other terms commonly used to describe a person’s emotional state;
xii. For chatbots that (i) are erotic, romantic, or used for erotic or romantic purposes, or which are otherwise prohibited by these terms and conditions; (ii) are personas of specific people without their explicit consent; (iii) claim to have special wisdom/insight/knowledge, unless very clearly labeled as being for entertainment purposes only; or (iv) enable End Users to create their own chatbots without oversight;
xiii. Except for customers approved for modified content filtering, to identify or verify individual identities based on people's faces, voices, or other physical, physiological, or behavioral characteristics;
xiv. For unlawful tracking, stalking, or harassment of a person;
xv. Without the individual’s valid consent, for ongoing surveillance or real-time or near real-time identification or persistent tracking of the individual using any of their personal information, including biometric data;
xvi. For facial recognition purposes (including identification or verification of individual identities) by or for a state or local police department in the United States;
xvii. For any real-time facial recognition technology on mobile cameras used by any law enforcement globally to attempt to identify individuals in uncontrolled, "in the wild" environments, which includes (without limitation) police officers on patrol using body-worn or dash-mounted cameras using facial recognition technology to attempt to identify individuals present in a database of suspects or prior inmates;
xviii. To generate content with the purpose of removing or altering content credentials or other provenance methods, marks, or signals (AI Content Credentials) that indicate that the content was generated by a Resident AI Assistant;
xix. To generate content with the purpose of misleading others about whether the content was generated by Resident AI Assistant; or
xx. To detect AI content credentials with the purpose of removing or altering them.
