Proposed Revisions to the Workforce Dwelling Unit Administrative Policy Guidelines to be Presented to the Board of Supervisors

The Board of Supervisors directed staff to prepare for public hearing modifications to the Fairfax County Board of Supervisors’ Countywide and Tysons Urban Center Administrative Policy Guidelines on December 5, 2023, with the authorization to consider revisions to the county’s WDU Policy in the Comprehensive Plan Guidelines for the Provision of Workforce Dwelling Units, Appendix 1 of the Policy Plan Housing Element, and the Area Plans.  The Board adopted revisions to the Workforce Dwelling Unit policies on September 10, 2024. The Administrative Guidelines serve as the implementation and administrative mechanism for the WDU Policy and address such aspects as integration and dispersion of WDUs within a development; technical requirements for the units; WDU sale, resale, and rental requirements; and legal documentation for commitment of the WDUs.

The proposed revisions would incorporate the recent policy changes; remove overlapping guidance with the policy; translate the structure and language in the document into plain English to make the document easier to read and understand; encourage earlier submission of the legal documents for review; identify DHCD involvement in the review process; reflect adjustments to the initial and resale pricing formulas; and address certain covenant recordation concerns. Clarifications to current guidance with more specific direction is also proposed, including revised guidance on transferring WDUs within developments with multiple unit types. Editorial changes to typographic and grammatical issues are also proposed. If adopted by the Board, the revised Administrative Guidelines would replace the current Administrative Guidelines, adopted February 23, 2021.

Board of Supervisors’ Public Hearing is scheduled for March 18, 2025

The Fairfax County Board of Supervisors will hold a public hearing on March 18, 2025 at 4:30 PM in the Board Auditorium of the Government Center, 12000 Government Center Parkway, Fairfax, Virginia 22035 to consider proposed revisions to Administrative Guidelines. The public hearing is available to view live on Channel 16 and stream live online at www.fairfaxcounty.gov/cableconsumer/channel-16/live-video-stream. Live audio of the meeting may be accessed at 703-324-7700. At the public hearing any and all interested persons will be given an opportunity to express their views regarding the application. Those wishing to testify may do so in person, via phone or pre-recorded YouTube video. Speakers wishing to testify via video must register by signing up online below or by calling the Department of Clerk Services at 703-324-3151, TTY 711 (Virginia Relay Center), and must submit their video no later than 9 a.m. on the day prior to the hearing. Speakers wishing to testify via phone must sign up to testify no later than 12:00 p.m. the day of the hearing to be placed on the Speakers List. Speakers not on the Speakers List may be heard after the registered speakers have testified.
