All bond motions and motions to amend conditions of bond must be filed by 2:00PM in person in the clerk’s office. The motion for bond and motion to amend the conditions of bond forms are multi-part forms and must be obtained in the Clerk’s Office.
Motions for Bond and Motions to Amend the conditions of bond for:
- Criminal cases (including Traffic felony cases) must be filed in the Criminal Clerk’s office in Room 204.
- Traffic cases and Town of Vienna and Town of Herndon cases must be filed in the Traffic Clerk’s office in Room 106.
- Fairfax City cases must be filed at the Fairfax City courthouse.
All bond motions and motions to amend the conditions of bond are heard Mondays through Fridays at the Fairfax County courthouse at 8:30AM in courtroom 2J.
Once you file the bond motion or motion to amend the conditions of bond with the clerk’s office, you must submit a copy to the Court Services Division in Room 203 and a copy to the Commonwealth Attorney in Room 114. Exceptions to this procedure are Fairfax City, Town of Vienna, and Town of Herndon cases.
For Fairfax City cases, you must submit a copy to the Court Services Division in Room 203 and email a copy to the City Prosecutor's Office at city-prosecutor@fairfaxva.gov .
For Town of Vienna and Town of Herndon cases, you must submit a copy with the Court Services Division in Room 203 and email a copy to the Town Prosecutor’s Office at sbriglia@brigliahundley.com.
