Development Agreement

• Plan name is misspelled, missing key words or out of order (ex. Agreement says Smith Subdivision Sec. 1 instead of Smith Subdivision, Landbay 2, Section 1, Parcel 3 as shown on plan)
• Plan number is missing digits or has extra digits (ex. Plan, PAWS and bond/permit package letters says "1234-SP-001" but agreement say "001234-SP-001-2" or "1234-SP-01")
• Form of payment and/or bond amount is not listed, or lists wrong amount and information
• Project name, plan number or agreement date missing or incorrect on the header of the second page

Signature Blocks

• Missing or wrong title(s)
• Missing or wrong printed name
• Missing middle initial in signature or in printed name
• Developer's name is wrong
• "By" lines missing or incorrect

Notary Blocks

• Notary doesn't include title next to name (development agreement only)
• Notary notarizes own signature
• Notary date is before date of agreement
• Notary registration number missing (Virginia)
• Missing notary seal

Signature Authority

• Name and/or title on agreement doesn't match signature authority
• Developer remits pertinent sections of operating agreements/bylaws or refuses to provide them all together
• Consent of Members and/or Managers dated after date of development agreement
• LLC certs, secretary certs, etc. dated after date of development agreement
• Certifications not signed, notarized or sealed correctly
• Certifications signed by individual signing the agreement and not another officer of the company.

Performance Bonds

• Date of agreement referenced doesn't match date of development agreement
• Date Bond Executed has a big gap with Date of Agreement
• Bond amount is entered in liability limit field instead of treasury listing
• Name of surety company and bond number not listed or listed incorrectly on the header of the remaining pages
• Developer name and address not consistent with that shown on agreement
• The form is not signed or notarized correctly
• Power of attorney for the surety company lists the wrong attorney-in-fact
• Power of attorney is not dated consistently with the bond form.

Letters of Credit

• Amount written out or numerically instead of both (required)
• Developer name and address not consistent with that shown on agreement
• Coversheet added as page one and includes additional information that's not acceptable
• Expiry language adds "at our counters"
• Expiry date is not at least 6 months beyond the development agreement date
• Additional headers added not found on our sample
• Extra wording, commas, spacing…etc.
• Authorized officer's name and title not consistent with bank signature authority cert
• Signature and/or notary page on a separate page with no header reference to the letter of credit number and date.

Certificate of Insurance

• Plan name, number and additional insured missing from description of operations field
• Developer name and address don't match agreement
• Certificate holder field is completely wrong or missing/has incorrect information (suite number, office name, etc.)
