Processing Virginia Pollutant Discharge Elimination System (VPDES) Permits

Virginia Department of Environmental Quality (DEQ) protects human health and VA’s land and ground water resources, while encouraging the reuse of contaminated properties. The agency ensures protection of these resources through proactive regulation of solid and hazardous waste management and facilitates cleanup of contaminated soil and groundwater.

Who needs to apply a Virginia Pollutant Discharge Elimination System Permit (VPDES) Permit?

Operators of construction activities resulting in land disturbance:

equal to or greater than one acre; or
less than one acre AND are part of a larger common plan of development or sale that ultimately disturbs one or more acres (i.e., subdivision), including additions or modifications to existing Single Family Dwelling (SFD residential) structures.

Please note, permit coverage is required if one acre or greater of land will be disturbed, regardless of the size of the individually owned or developed sites.

General Registration Statements (VAR10 Permit) for New Permit Coverage:

Submission Steps:

Email the VAR10 General Registration Statement to LDSConstructionGP@fairfaxcounty.gov, or submit the VAR10 General Registration Statement to Bonds and Agreements Center (BAC) with the Permit Package and pay the VPDES Registration Fee of $339.00 via your PLUS account under your shopping cart or mail a check to: Bonds and Addressing Center, 12055 Government Center Parkway, Suite 230, Fairfax, VA 22035.
BAC will process the payment and file the VAR10 General Registration Statement until the plan has reached technical approval.
Email LDSConstructionGP@fairfaxcounty.gov when your plan has reached technical approval by Fairfax County, so that the VAR10 General Registration Statement can be sent to DEQ for processing. BAC cannot send the VAR10 General Registration Statement to DEQ before the plan has reached technical approval.
BAC will process the VAR10 General Registration Statement in the DEQ Stormwater Construction General Permit System once the plan has reached technical approval. Please note, DEQ’s Review Time is approximately 13 weeks out.
Once DEQ has approved their review DEQ will issue the Construction General Permit (CGP) and email it to LDSConstructionGP@fairfaxcounty.gov and to the Operator.
After the plan is approved and all post-approval conditions have been satisfied and set to “met” Site Application Center (SAC) will issue the Land Disturbance Permit (LDP) and will reference the VAR10 number in the permitting system.

Modifications and Transfers of Ownership to VAR10 Permits

Modifications are required at the discretion of Fairfax County. Modifications are typically only required when a significant revision or change has occurred to the site such as an increase in disturbed area (not a decrease). Please consult with your Fairfax County Site Reviewer for Stormwater Engineering with Land Development Services (LDS) to determine if a modification needs to be submitted.

Modifications and Transfers of Ownership to the VAR10 General Registration Statement should be emailed to LDSConstructionGP@fairfaxcounty.gov and paid via your PLUS account under your shopping cart or mail in a hard copy of the modification and check to Bonds and Addressing Center, 12055 Government Center Parkway, Suite 230, Fairfax VA 22035.

Once BAC receives the Modification or Transfer of Ownership, BAC will process the request in the DEQ Stormwater Construction General Permit System. Once DEQ has completed their review, they will issue the approved Construction General Permit to the Operator and email a copy to the county (and to the old Operator if a Transfer of Ownership was requested).

VAR10 Notice of Termination (VAR10 NOT)

Notices of Termination (NOTs) to the VAR10 General Registration Statement should be emailed to LDSConstructionGP@fairfaxcounty.gov and paid via your PLUS account under your shopping cart or mail in a hard copy of the modification and check to Bonds and Addressing Center, 12055 Government Center Parkway, Suite 230, Fairfax, VA 22035.

NOT’s are required prior to Bond Release and can only be submitted to DEQ for termination if the Fairfax County Site Inspector has signed off on the inspection. DEQ will issue the CGP VAR10 NOT and email it to the county and to the Operator.
