When requesting attorney's fees or interest based on a written contract, note, or other instrument, the applicable areas must be highlighted or circled on the document. If the contract, note, or other instrument allows for "reasonable" attorney's fees, but states a specific amount, then an affidavit must be filed noting the hours spent multiplied by the attorney's hourly rate to support the award of attorney's fees. Unless otherwise specified, the legal rate of interest is set by Code of Virginia, §6.2-302 (currently six (6) percent per annum).
