Motions for Criminal & Traffic

Traffic Motions are heard each day at 9:00AM in Courtroom 1D. Criminal Motions are heard each day at 9:30AM in Courtroom 2K. 

Motions filed by 8:30AM in the Clerk's Office can be heard the same day. Exceptions are Bond Motions. Bond Motions must be filed in person in the Criminal Clerk's office by 2:00PM the day Prior. 

Motions for Evaluation of Competency must be filed on the court's Motion for Evaluation of Competency form. If the motion is for a 169.1 or 169.5 evaluation, then the Request for Forensics Evaluation form must also be filed with the motion. 

Motion for a Bed-to-Bed Transfer must be filled out in its entirety. Please note that a Bed-to-Bed Transfer Order cannot be granted if the defendant has a detainer for another jurisdiction.  

Motion for a Restricted Operator's License (ROL) - petitioner must bring 3 items (1) a current DMV Record and Compliance Summary, (2) an updated ROL application, and (3) an ASAP status letter.

Motion for Release of Impounded Vehicle - must be filed by the registered owner of the vehicle. The owner must bring proof of vehicle ownership and the impoundment or towing sheet. 

Motions can be filed in person or by email at GDCMail@fairfaxcounty.gov. Exceptions are Bond Motions. Bond Motions must be filed in person in the Criminal Clerk's office by 2:00PM the day prior. You should allow at least 2 business days for the court to process your motion if filled by email.
