To guarantee development is completed per the approved site-related plan and in a reasonable timeframe, a developer must enter into an agreement with the county and post a security, or “bond.” In the event a developer defaults, the county utilizes the bond funds to complete the public improvements.
Lots that were created before the zoning ordinance was enacted or were created by recordation of a plat or deed without county approval may be “validated” by the county. If the legality of a lot is unclear, a lot validation can determine whether the lot meets certain requirements and can be validated so that a building permit may then be issued for the development of that lot.
A Stormwater Ordinance Determination (SWOD) can be requested to determine if a proposed project meets the criteria for stormwater ordinance time limits on applicability of approved design criteria (“Time Limits”) pursuant to § 124-1-11 or grandfathering of § 124-1-12.
Utility permits are required when dry utility lines are proposed to be placed within rights-of-way which have not yet been accepted into the Virginia Department of Transportation (VDOT) system and/or for proposed work within county easements or on county-owned property.
