Delinquency

Delinquency refers to a criminal complaint involving a juvenile, which Virginia law defines as a person under the age of 18. These cases involve crimes committed against individuals, family members, or businesses within Fairfax County. Examples include theft, assault, destruction of property, breaking and entering, fraud, and similar offenses. Delinquency offenses may be misdemeanors or felonies. Felony offenses carry more serious consequences and may only be filed by law enforcement officers. If you believe you are the victim of a crime, it is best to contact your local police department before reaching out to Juvenile Intake.

When a juvenile is alleged to have committed an offense in Fairfax County, a law enforcement officer or other petitioner, such as a parent or member of the public, may refer the case to Juvenile Intake. Referrals may be submitted through an online form (Juvenile Intake Portal) or by calling 703-246-2495 to request an appointment. Intake Officers review each referral using criteria set by the Code of Virginia, including the needs of the child, the seriousness of the charge, and any risk to public safety.

After the intake meeting, the intake officer may:

  • Refer a youth to community resources or to a diversion program
  • File a petition for a formal court hearing
  • Issue a shelter care order or detention order
