Procedures
Attorneys must appear for Term Day. If the Defendant is represented by counsel, the Defendant need not appear unless there is a direct indictment. The purpose of Term Day is to set Circuit Court plea or trial dates.
Bench warrants may be issued for those defendants who have been directly indicted and who fail to appear for Term Day. Individuals incarcerated for charges pending at Grand Jury, and who are represented by counsel, will not appear for Term Day. If it is necessary to set a trial date for a person who is incarcerated and counsel has not yet been retained or appointed, the Clerk's Office will notify the Sheriff's Office so that the defendant will be brought to the Term Day proceeding.
